1. Agreement to Terms

By accessing or using FlowPOS (the "Service"), you agree to be bound by these Terms of Service (the "Terms"). If you do not agree to these Terms, you must not access or use the Service.

The Service is owned and operated by Individual Entrepreneur Vladimir Savelev (ID 345831317), registered in Batumi, Georgia (the "Operator").

2. Definitions

  • "Service" means the FlowPOS cloud-based point-of-sale platform, including all associated websites, applications, APIs, and documentation.
  • "User" means any individual or entity that accesses or uses the Service.
  • "Account" means the registered account a User creates to access the Service.
  • "Tenant" means an individual business workspace within the Service, associated with one or more Users.
  • "Subscription" means the paid or free plan under which a User accesses the Service.
  • "Content" means any data, text, images, menus, orders, inventory records, financial information, or other materials uploaded, entered, or generated through the Service.

3. Description of Service

FlowPOS is a cloud-based point-of-sale (POS) system designed for restaurants, cafes, bars, and retail businesses. The Service provides the following features:

  • Order Management — create, track, and manage customer orders
  • Menu Management — build and maintain digital menus with categories, modifiers, and pricing
  • Inventory Tracking — monitor stock levels, ingredients, and supplier information
  • Staff Management — manage employees, roles, permissions, and work schedules
  • Analytics & Reporting — access sales reports, financial summaries, and business insights
  • Kitchen Display System (KDS) — real-time order display for kitchen operations
  • QR Menu — generate scannable QR codes for digital customer-facing menus
  • Delivery Integrations — connect with Wolt, Glovo, Bolt Food, and Yandex Eda
  • AI Assistant — AI-powered business insights and recommendations
  • Invoice Scanning — automated extraction of data from supplier invoices
  • Recipe Suggestions — AI-generated recipe ideas based on your inventory

Feature availability may vary by Subscription plan.

4. Account Registration

  • You must provide accurate, current, and complete information during registration.
  • You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your Account.
  • You must notify us immediately of any unauthorized access to your Account.
  • One person or entity may create and maintain multiple Tenants for different business locations or operations.
  • You must be at least 16 years of age to create an Account and use the Service.
  • We reserve the right to refuse registration or suspend Accounts at our discretion if we reasonably believe information provided is inaccurate or the Account is being used in violation of these Terms.

5. Subscription Plans & Billing

The Service offers multiple Subscription plans with varying feature sets and pricing. Current plan details and pricing are displayed on the pricing page within the Service and on our website.

Paid Subscriptions are billed on a monthly recurring basis. Prices are subject to change; we will provide at least 30 days written notice before any price increase takes effect.

Subscriptions automatically renew at the end of each billing period unless you cancel. You may cancel your Subscription at any time through your Account settings. Upon cancellation, you will retain access to paid features until the end of your current billing period.

No partial-month refunds are issued for cancellations made mid-billing cycle. Please refer to our Refund Policy for details on eligible refunds.

6. Payment Processing

Payments are processed by third-party payment providers, specifically Stripe and Paddle. By subscribing to a paid plan, you agree to the terms of the applicable payment processor.

We do not store your credit card numbers or full payment details on our servers. All payment information is handled directly by the payment processor in compliance with PCI DSS standards.

If a payment fails, we will attempt to notify you and may retry the charge. Continued payment failure may result in a downgrade to the Free plan or suspension of your Account.

You are solely responsible for any applicable taxes, duties, or levies imposed by your jurisdiction in connection with your use of the Service.

7. Your Data & Content

You retain full ownership of all Content you upload, enter, or create within the Service. We do not claim any ownership rights over your Content.

We do not sell, rent, or share your business data with third parties for their own purposes.

You may export your data at any time using the export features available within the Service.

Upon Account deletion, your Content will be permanently removed from our systems within 30 days, except where retention is required by applicable law (such as financial records required under Georgian tax law).

By using the Service, you grant us a limited, non-exclusive license to process, store, and transmit your Content solely for the purpose of providing, maintaining, and improving the Service.

8. Acceptable Use

You agree not to:

  • Use the Service for any unlawful, fraudulent, or harmful purpose
  • Attempt to gain unauthorized access to the Service, other Accounts, or our systems and infrastructure
  • Interfere with, disrupt, or place an unreasonable burden on the Service or its underlying infrastructure
  • Reverse-engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Service
  • Resell, sublicense, or redistribute access to the Service without prior written authorization from the Operator
  • Scrape, crawl, or use automated means to extract data from the Service beyond its intended use
  • Upload, transmit, or distribute any malicious code, viruses, or harmful content
  • Use the Service to infringe upon the intellectual property rights of others

Violation of these terms may result in immediate suspension or termination of your Account.

9. AI Features

The Service includes optional AI-powered features, including the AI Business Assistant, Invoice Scanning, and Recipe Suggestions.

These features utilize third-party AI model providers to process your requests. When you use AI features:

  • Relevant data from your Account is transmitted to the AI provider over encrypted connections
  • Your data is not used to train the AI provider's models
  • Data sent to AI providers is not retained beyond the duration necessary to fulfill your request

You may disable AI features at any time through your Account settings. AI-generated content is provided for informational purposes and should not be relied upon as professional advice.

10. Intellectual Property

The FlowPOS name, logo, brand identity, software code, user interface design, documentation, and all related materials are the exclusive property of the Operator and are protected by applicable intellectual property laws.

Your Content remains your property as described in Section 7.

You may not use the FlowPOS name, logo, or branding without prior written consent from the Operator.

Feedback, suggestions, and feature requests submitted by Users may be used by us to improve the Service without any obligation of compensation or attribution.

11. Third-Party Integrations

The Service may integrate with third-party platforms, including delivery services (Wolt, Glovo, Bolt Food, Yandex Eda), payment processors (Stripe, Paddle), and other services.

Third-party integrations are governed by the respective terms and privacy policies of those providers. We are not responsible for the availability, accuracy, or reliability of third-party services.

Enabling a third-party integration may involve sharing certain data with that provider. You should review the third party's terms before enabling any integration.

12. Service Availability & SLA

We strive to maintain 99.9% uptime for the Service. However, we do not guarantee that the Service will be available at all times without interruption.

Scheduled maintenance will be performed with reasonable advance notice when possible. We are not liable for temporary unavailability caused by:

  • Scheduled or emergency maintenance
  • Force majeure events (natural disasters, war, pandemics, government actions)
  • Outages of third-party services, hosting providers, or internet infrastructure
  • Your own internet connection or hardware issues

13. Limitation of Liability

To the maximum extent permitted by applicable law:

  • The Operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits, lost revenue, lost data, business interruption, or cost of substitute services.
  • The Operator's total aggregate liability arising from or related to these Terms or your use of the Service shall not exceed the total amount of fees paid by you to us during the 12 months immediately preceding the event giving rise to the claim.
  • The Service is provided on an "as is" and "as available" basis. We make no warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

14. Indemnification

You agree to indemnify, defend, and hold harmless the Operator and its affiliates, officers, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising from:

  • Your use of the Service
  • Your Content
  • Your violation of these Terms
  • Your violation of any applicable law or third-party rights

15. Termination

  • You may close your Account at any time through your Account settings or by contacting us at legal@flowpos.pro.
  • We may suspend or terminate your Account for violation of these Terms. Except in cases of serious or repeated violations, we will provide at least 14 days written notice before termination.
  • In cases of serious violations (fraud, illegal activity, security breaches), we reserve the right to suspend or terminate your Account immediately without prior notice.
  • Upon termination, your data will be deleted within 30 days unless retention is required by applicable law.

16. Modifications to Terms

We may update these Terms from time to time. Material changes will be communicated to you via email or in-app notification at least 30 days before taking effect.

Your continued use of the Service after the effective date of any changes constitutes your acceptance of the updated Terms. If you do not agree to the changes, you must stop using the Service and close your Account.

17. Dispute Resolution

In the event of any dispute arising from or relating to these Terms or the Service, the parties agree to first attempt resolution through good-faith negotiation by contacting legal@flowpos.pro.

If the dispute cannot be resolved through negotiation within 30 days, it shall be submitted to the exclusive jurisdiction of the courts of Batumi, Georgia.

These Terms are governed by and construed in accordance with the laws of Georgia.

18. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

19. Entire Agreement

These Terms of Service, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and the Operator regarding your use of the Service, superseding any prior agreements or understandings.
